2. What aiBrenda is

aiBrenda is an entertainment app and website: a conversation companion powered by artificial intelligence, which you can chat with by voice or in writing. It is designed especially for older people, although any adult can use it.

aiBrenda does not sell physical products or deliver anything to your home. All it offers is conversation time. That is why we do not need, ask for or keep your postal address.

3. What you accept by using aiBrenda

By using the app or the website you accept this Legal Notice. Our Privacy Policy, Cookie Policy and Terms and Conditions also apply alongside it. If you do not agree, please do not use aiBrenda.

4. Who can use aiBrenda

Creating an account is completely free. If you need additional time, you can Top-up or sign up for a subscription plan through the Google Play Store (must be 18 or older).

5. Payments are handled by Google Play

All aiBrenda payments (top-ups and subscriptions) are made through Google Play. Google takes the payment and processes your payment details under its own terms, which you can find here: Google Play Terms of Service.

aiBrenda does not ask for or keep any bank details: no account numbers, no credit or debit cards, and no other electronic means of payment.

6. Brenda is a character created with artificial intelligence

• Brenda’s replies are generated automatically by an artificial intelligence system from external providers (currently Google Gemini; in the future there may be others, such as OpenAI, ElevenLabs, etc.).
• Remember: Brenda is a machine, not a person.
• She may make mistakes, misunderstand what you say, or give incomplete or out-of-date information.
• She is not an advice service. Brenda does not give medical, legal, financial, tax or psychological advice. If you bring up any of these subjects during a conversation, she will suggest that you consult a professional.
• She is not an emergency service. If you are in danger or need urgent help, call 999 or 112 (in the UK), or the emergency number in your country.
• Do not make important decisions based only on what Brenda tells you.

7. Acceptable use

You agree to use aiBrenda lawfully and respectfully. For example, you must not:

• Use it for illegal activities, or to harass, threaten or deceive other people.
• Try to access other people’s accounts, damage the service or get around its security measures.
• Try to make the artificial intelligence generate illegal, violent or sexual content, or content that incites hatred.
• Copy, resell or commercially exploit the service without our permission.

We may suspend or close accounts that break these rules.

8. Liability

We do everything we can to make sure aiBrenda works well, but:

• We cannot guarantee that it will always be available or free of errors. There may be interruptions or lag due to maintenance, technical faults or problems with our providers (internet connection, servers, artificial intelligence services).
• The artificial intelligence depends on external providers. Each of them has its own terms and responsibilities for its technology. We do not control how their models are built and cannot guarantee the content of every reply.
• We are not liable for damage resulting from misuse of the service, from decisions made on the basis of the artificial intelligence’s replies, or from causes beyond our control.

Nothing above limits the rights the law gives you as a consumer, or our liability in cases where the law does not allow it to be limited.

9. Intellectual property

The aiBrenda brand, the aiBrenda.co and iaBrenda.com domains, Brenda’s name and image, the design, texts, code and all other elements of the service are owned by Comercio Social Digital, S.L. or used under licence. You may use them only to enjoy aiBrenda. What you write or say remains yours.

10. Links to other websites

We may include links to third-party websites, such as Google Play. We are not responsible for their content or their policies.

11. Changes to this notice

We may update this Legal Notice. If the change is significant, we will let you know in the app or on the website.

12. Governing law

This Legal Notice is governed by Spanish law. If you are a consumer, you keep the protection given to you by the laws of your country of residence, and you can bring a claim before the courts where you live.
